Comentario a la sentencia rol N° 15.981 del Tribunal Constitucional
Based on the Chilean Constitutional Court’s decision No. 15,981, which declared the unconstitutionality of several articles and annotations of the already enacted and published 2025 Budget Law, this paper analyzes the exceptional nature of constitutional review in this type of legislation, as well as the effects of the subsequent ineffectiveness of the challenged provisions. It also examines prior case law and the Executive Branch’s practice in correcting promulgations, concluding that the existing constitutional and legal framework contains gaps that generate uncertainty regarding legal certainty and the scope of these rulings.; A partir de la sentencia Rol N° 15.981 del Tribunal Constitucional chileno, que declaró la inconstitucionalidad de diversos artículos y glosas de la Ley de Presupuestos 2025 ya promulgada y publicada, se analiza la excepcionalidad del control en este tipo de leyes, así como los efectos de la ineficacia sobreviniente de las normas cuestionadas. Asimismo, se revisa jurisprudencia previa y la práctica del Ejecutivo en la corrección de promulgaciones, concluyendo que la regulación constitucional y legal presenta vacíos que generan incertidumbre respecto de la seguridad jurídica y del alcance de estas sentencias.

<summary type="text">Political party federations and confederations in Chile: A doctrinal reconstruction based on the 1972 Tricel decision and its projection onto the current legal framework; Federación y confederación de partidos políticos en Chile: Reconstrucción doctrinal a partir del fallo del Tricel de 1972 y su proyección en el ordenamiento vigente
This article analyzes the concept of a federated party in Chilean public law based on the decision of the Electoral Qualifying Tribunal (Tricel) published on June 9th, 1972, which represents the most comprehensive doctrinal development of this concept in Chile that this research has identified. The Tricel responded to fourteen inquiries regarding the formation, candidacies, and parliamentary representation of federated parties, thereby establishing a coherent legal framework. The article examines this doctrine, its implications for Law No. 18,603, and its comparison with the Brazilian and Uruguayan models, concluding that Chile lacks a coherent framework for regulating forms of supra-party association other than mergers.  ; El artículo analiza el concepto de partido federado en el derecho público chileno a partir del fallo del Tribunal Calificador de Elecciones (Tricel) publicado el 9 de junio de 1972, el desarrollo doctrinal más extenso que esta investigación ha identificado sobre la figura en Chile. El Tricel respondió a catorce consultas sobre constitución, candidaturas y representación parlamentaria de los partidos federados, construyendo una arquitectura jurídica coherente. El artículo examina esa doctrina, su proyección hacia la Ley 18603 y su comparación con los modelos brasileño y uruguayo, concluyendo que Chile carece de un régimen coherente para regular formas de asociación suprapartidaria distintas de la fusión.

<summary type="text">Restrictions on the praxis of the social function of property in Chile; Restricciones en el ejercicio de la función social de la propiedad en Chile
This paper examines the social function of property in Chile, with particular emphasis on the constraints it encounters in legal practice. To this end, it analyzes the theoretical, doctrinal, and case law development of the social obligations of property within the national legal framework, focusing on the main restrictions it faces: the guarantee of the essential content of property, the doctrine of regulatory taking, and the absolute statutory reservation. Subsequently, it will examine the law–regulation dynamics, offering various doctrinal, jurisprudential, and practical perspectives on the matter. It further assesses the implications of these regulatory constraints through an analysis of Constitutional Court Judgment 13626-22, regarding the Urban Wetlands Act.; El presente trabajo indaga sobre la función social de la propiedad en Chile, centrándose particularmente en las restricciones que esta enfrenta en su praxis jurídica. Para ello, reflexiona en torno al desarrollo conceptual, doctrinario y jurisprudencial de la función social en nuestro país, con especial atención a tres de las principales restricciones que enfrenta: la garantía de contenido esencial de la propiedad, la doctrina de expropiación regulatoria y la reserva legal absoluta. Posteriormente, profundiza espe cialmente en la dinámica existente entre ley y reglamento, en el marco de las normas que regulan la función social, ofreciendo diversas perspectivas doctrinarias, jurisprudenciales y prácticas al respecto, junto con desarrollar un análisis de estas restricciones a la propiedad, a la luz de la sentencia de inaplicabilidad por inconstitucionalidad rol 13626-22, emitida por el Tribunal Constitucional, a propósito de la Ley de Humedales Urbanos.

<summary type="text">The suspension of voting rights upon criminal indictment: A case study; La suspensión del derecho a sufragio por acusación penal. Análisis de un caso
This article examines whether the suspension of voting rights under Article 16 No. 2 of the Chilean Constitution may be triggered solely by an indictment filed by the Public Prosecutor’s Office or requires prior judicial review. Drawing on the Electoral Qualification Tribunal’s judgment in Case 1978-2025, it contrasts a literal interpretation with a systematic reading of Articles 16 No. 2 and 83, the presumption of innocence, and the protection of political rights. It argues that an indictment alone is insufficient and that a final order opening the oral trial is the first judicial milestone capable of triggering the suspension.; Este artículo examina si la suspensión del derecho a sufragio del artículo 16 número 2 de la Constitución puede producirse por una acusación del Ministerio Público o exige control judicial previo. A partir de la sentencia rol 1978-2025 del Tribunal Calificador de Elecciones, se contrasta una interpretación literal con una lectura sistemática de los artículos 16 número 2 y 83, la presunción de inocencia y la protección de los derechos políticos. Se sostiene que la acusación no basta y que el auto de apertura firme o ejecutoriado constituye el primer hito jurisdiccional apto para producir la suspensión
