This article addresses the procedural challenges arising from the reparations ordered in the case of Vega González et al. v. Chile. Specifically, it analyzes the reparations measure that ordered the State of Chile to review and/or annul the reductions in sentences resulting from the unconvencional application of the “half prescription” institution, which in practice means rendering final national judgments ineffective. The study identifies a point of conflict between the traditional conception of res judicata in domestic law as a tool that provides legal certainty, and the international obligation to provide reparations when a State has incurred in responsibility, a key aspect for the effectiveness of the American Convention on Human Rights and its jurisprudential interpretation. Thus, given the lack of a clear procedure for compliance with international judgments in Chilean law, the courts have had to provide a solution by resorting to a review of conformity with international law, allowing them to implement the ordered reparations. This gap offers an opportunity de lege ferenda for our legislation by establishing a procedure that allows the review and/or annulment of judgments in compliance with international decisions.; Este artículo aborda los desafíos procesales derivados de las medidas de reparación ordenadas en el caso Vega González y otros vs. Chile. En concreto, se analiza la medida de reparación que ordenó al Estado de Chile revisar o anular las reducciones de las penas que hubieran derivado de la aplicación inconvencional de la media prescripción, lo que en la práctica implica dejar sin efecto sentencias nacionales firmes. El estudio identifica, por un lado, un punto de colisión entre la concepción tradicional de la institución de cosa juzgada en el derecho interno, en tanto herramienta que proporciona seguridad jurídica; y, por otro, la obligación internacional de reparar cuando un Estado ha incurrido en responsabilidad, aspecto clave para la eficacia de la Convención Americana de Derechos Humanos y su interpretación jurisprudencial. Así, ante la inexistencia de un procedimiento claro de cumplimiento de sentencias internacionales en la legislación chilena, ha correspondido a los Tribunales de Justicia proporcionar una solución al recurrir a un control de convencionalidad que le permita dar curso a la reparación ordenada. Este vacío ofrece una oportunidad de lege ferenda para nuestra legislación, estableciendo un procedimiento que permita la revisión o anulación de sentencias en cumplimiento de decisiones internacionales.

<title>“Performative jurisprudence”: The (often) neglected dimension of human rights jurisprudence</title>

The concept «performative jurisprudence» is proposed to describe the specific effects of human rights court decisions, correlated with their symbolic impacts, primarily linguistic in nature. This concept is articulated within Legal Consciousness Studies. This socio-legal approach analyzes the cognitive frameworks composed of beliefs, imaginaries, and narratives through which law is understood and applied in everyday life beyond official texts. These frameworks generate new interpretive repertoires that influence social practices. In addition to direct and verifiable material compliance with their orders (e.g., to compensate, investigate, provide redress, or reform a law), human rights decisions by national and regional courts have transformative effects related to their impact that also redefine these cognitive frameworks. Twenty years after the Almonacid case, it is important to reevaluate the justification for conventionality review in light of the broader transformative consequences of jurisprudence. The concept «performative jurisprudence» contributes to ongoing research on the nature, content, and structure of jurisprudence in general and Inter-American jurisprudence in particular, by drawing on its relationships with other concepts, such as «transformative constitutionalism», «inter-Americanization of law», and «multilevel constitutionalism».; Propongo denominar «jurisprudencia performativa» a la clase particular de efectos de las decisiones de los tribunales de derechos humanos ligados a sus impactos simbólicos de naturaleza fundamentalmente lingüística. Este concepto se articula en los Estudios sobre Conciencia Jurídica. Esta corriente sociojurídica analiza los marcos cognitivos, integrados por creencias, imaginarios y narrativas, a través de los cuales se comprende y utiliza el derecho en la vida cotidiana, más allá de los textos oficiales. Estos marcos generan nuevos repertorios interpretativos que influyen en prácticas sociales. Las decisiones sobre derechos humanos de tribunales nacionales y regionales, además del cumplimiento material directo y verificable de sus órdenes (indemnizar, investigar, reparar o reformar una ley), tienen otro tipo de efectos transformadores relacionados con sus impactos, que también resignifican dichos marcos cognitivos. A veinte años del caso Almonacid es pertinente volver sobre la justificación del control de convencionalidad a partir de las consecuencias transformadoras más amplias de la jurisprudencia. El concepto «jurisprudencia performativa» puede contribuir a la investigación sobre la naturaleza, el contenido y la estructura de la jurisprudencia, en general, e interamericana, en particular, a partir también de sus relaciones con otros conceptos, tales como «constitucionalismo transformador», «interamericanización del derecho» o «constitucionalismo multinivel».

This paper analyses the development and impact of conventionality control in Spain, considering how it is exercised by the various branches of government (legislative, executive and judicial). In the first part, the author explains the relatively novel nature of conventionality control in Spain. The second part tackles the establishment of such control through Constitutional Court Judgment 140 of 2018, as well as its inspiration from the Almonacid Case of the Inter-American Court of Human Rights. The third and fourth parts deal with recent and latest experiences of conventionality control in Spain before and after the aforementioned Constitutional Court Ruling. Finally, the author concludes by emphasizing the need to consolidate the conventionality control as a constitutional mandate in Spain and to ensure consistency with the overall system of law sources, in the interests of the effectiveness of human rights standards and the realization of the pro persona principle.; Este trabajo analiza la evolución e impacto del control de convencionalidad en España, tomando en consideración su ejercicio por parte de las distintas ramas del poder público (legislativo, ejecutivo y judicial). En la primera parte, el autor explica el carácter relativamente novedoso del control de convencionalidad en España. La segunda parte aborda la consagración del control de convencionalidad mediante la sentencia 140 de 2018 del Tribunal Constitucional, así como su inspiración en el caso Almonacid de la Corte Interamericana de Derechos Humanos. La tercera y cuarta partes se ocupan de las experiencias recientes y últimas del control de convencionalidad en España antes y después del citado pronunciamiento del Tribunal Constitucional. Por último, el autor concluye enfatizando la necesaria consolidación del control de convencionalidad como mandato constitucional en España y la coherencia con el sistema global de fuentes en aras de la efectividad de los estándares de derechos humanos y la realización del principio pro persona.
