<description>De William Blackstone a Roscoe Pound: genealogía de una epistemología jurídica angloamericana
Through generations revisiting his thought, Roscoe Pound has become an American legal realism classic. Intellectual biographies attempting to reconstruct the genesis of his thought, explain influences, and provide historical precedents are not lacking. However, these attempts rarely view the putative father of realism through lenses other than the historiographical trope of the antithesis formalism/anti-formalism. This distinction presumes the ontology of law prior to its science. In this article, a new perspective on the law as epistemology will serve to trace back the genealogy of Pound's assumptions. This shift will lead us to revisit the parallel paths of the common law tradition, including names such as William Blackstone and Henry S. Maine on the one hand and Jeremy Bentham and John Austin on the other; these paths converging in Oliver Wendell Holmes, Jr. before leading to our author. Through this, we will see how laws' epistemological status has wavered in this tradition between formal and material truth.; La exégesis, generación tras generación, del pensamiento de Roscoe Pound lo ha convertido en un clásico del realismo jurídico americano. No han faltado biografías intelectuales tratando de reconstruir su génesis, explicar influencias y documentar antecedentes. Sin embargo, estos intentos raramente sitúan las ideas de este padre putativo del realismo fuera de la línea demarcada por el tropo historiográfico de la antítesis entre formalismo y antiformalismo. Una distinción que asume siempre la ontología del derecho antes de afrontar su ciencia. En este artículo, se adoptará una nueva mirada desde el derecho como epistemología para elaborar la genealogía de los presupuestos de Pound. Dicho cambio nos llevará a revisitar los caminos paralelos de la tradición de Common Law, con figuras como William Blackstone y Henry S. Maine, por un lado, y Jeremy Bentham y John Austin por otro; caminos que se cruzan en Oliver Wendell Holmes, Jr. antes de desembocar en nuestro autor. A través de este ejercicio, podremos ver cómo, en dicha tradición, el estatuto epistemológico de las normas ha oscilado entre verdad formal y material.

The research on lay justice and the formalization of land rights in central Chile during the nineteenth century reveals the coexistence and constant negotiation between, on the one hand, a proprietary culture characterized by unfolded domain and the value of possession and, on the other hand, the emerging processes of individual titling and full property ownership. These pages, summarizes a research agenda focused on the analysis of judicial land disputes and notarial deeds, showing that lay justice, administered by lay judges and local inhabitants, not only tended to resolve conflicts but also legitimized and adapted divided and possessory rights in a context of institutional transformation and evolving legal ideas. This phenomenon led to hybrid forms of domain, where possession and traditional divided rights were integrated into registered titles, demonstrating that formalization did not signify the disappearance of local practices, but rather their reconfiguration and persistence within new institutional formats. The research agenda has contributed to overcoming the legal formalism that underpins the discussion on this matter, highlighting instead lay justice as a dynamic space for the social agency of land rights, particularly in the case of small and medium-scale farmers who were customary holders of rights.; El examen de la justicia vecinal y la formalización de los derechos a la tierra en Chile central durante el siglo XIX revela la coexistencia y negociación constante entre, por un lado, una cultura propietaria caracterizada por el dominio desdoblado y por el valor de la posesión y, por otro, los procesos emergentes de titulación individual y la propiedad plena. Estas páginas sintetizan una agenda de investigación volcada al análisis de pleitos judiciales por tierra y escrituras notariales, evidenciando que la justicia vecinal, administrada por jueces legos y habitantes del territorio, no solo tendía a dirimir los conflictos, sino que también legitimaba y adaptaba derechos desdoblados y de posesión en un contexto de transformación institucional y de las ideas jurídicas. Este fenómeno condujo a formas híbridas de dominio, donde la posesión y los derechos desdoblados tradicionales se integraron en los títulos inscritos, demostrando que la formalización no significó la desaparición de las prácticas locales, sino su reconfiguración y persistencia en los nuevos formatos institucionales. La agenda de investigación ha contribuido a superar el formalismo legal que sustenta la discusión bibliográfica al respecto, resaltando, en cambio, la justicia vecinal como espacio dinámico para la gestión social de los derechos a la tierra, particularmente en el caso de pequeños y medianos agricultores, poseedores consuetudinarios de derechos.

<title>Rulings of the Supreme Court in Sexual Offense Cases Heard by the 1st District Court of Toluca (1882–1901)</title>

The main objective of this paper is to analyze how the authorities of the Federal Judicial Branch in Mexico heard and resolved amparo lawsuits related to sexual crimes—such as kidnapping, statutory rape, and rape—between 1882 and 1901. Based on a study of the files of amparo lawsuits filed before the First District Court of Toluca, the paper examines various judicial proceedings for sexual crimes. This analysis seeks to recover the legal arguments put forward by the authorities of the Judicial Branch of the State of Mexico regarding these crimes, which will allow us to understand the positions adopted by both district judges and the justices of the Supreme Court of Justice of the Nation. This will help elucidate how the administration of justice was configured in relation to sexual crimes committed against women during the period studied. An examination of the cases reveals, on the one hand, that some authorities tended to judge women based on their conduct and moral principles rather than legal ones; On the other hand, it shows that federal agencies adopted a stance more closely aligned with the defense of victims' legal rights, which was fundamental, as it set legal precedents for the determination and legal treatment of sexual violence against women.; El objetivo principal de este trabajo es analizar cómo las autoridades del Poder Judicial de la Federación en México conocieron y resolvieron juicios de amparo relacionados con delitos sexuales como el rapto, el estupro y la violación, entre 1882 y 1901. A partir del estudio de expedientes de juicios de amparo, promovidos ante el 1er Juzgado de Distrito de Toluca, se examinan diversos procesos judiciales por delitos sexuales. Este análisis busca recuperar los argumentos jurídicos esgrimidos por las autoridades del Poder Judicial del Estado de México en torno a estos delitos, lo cual permitirá comprender las posturas adoptadas tanto por los jueces de distrito como por los ministros de la Suprema Corte de Justicia de la Nación. Lo anterior permitirá dilucidar cómo se configuró la administración de justicia en relación con los delitos sexuales cometidos contra mujeres durante el periodo estudiado. El examen de los casos revela, por un lado, que algunas autoridades tendían a juzgar a las mujeres con base en su conducta y principios morales más que legales; por otro lado, muestra que las instancias federales asumieron una postura más apegada a la defensa de los derechos legales de las víctimas, lo cual resultó fundamental, en tanto sentó precedentes legales para la determinación y el tratamiento jurídico de la violencia sexual contra las mujeres.
