| dc.description | In a real democracy, we found specifics situations in which is possible and necessary to legitimately challenge of the law? In what follows, I will analyze the meaning of the idea of Civil Disobedience, as developed by Arendt in her 1969 article, putting in relation to the rest of her work, and specifically to some findings about the foundation of the modern republican political and its institutions, that she has already made six years earlier in On Revolution. I will introduce the conceptual conflict involved in civil disobedience and its demarcation from other contiguous political phenomena such as conscientious objection and the right to resistance. Second, I will expose b) how civil disobedience allows us to rethink the very meaning of the law and the political Constitution. While c) would allow us to reconsider the scope and meaning of the social contract, insofar as it reveals the infrastructure that a democratic Republic supposes, composed, at least in its most elementary dimension, of a horizontal contract or alliance of the many. | en-US |
| dc.description | En una democracia real, ¿hay situaciones específicas en que sea necesario y posible impugnar legítimamente la ley? En lo que sigue, analizaremos, en lo que sigue, el significado y alcance de la idea de desobediencia civil, tal como Arendt la desarrolla en su artículo de 1969, poniendo luego sus conclusiones en relación con el resto de su obra y en particular con algunos hallazgos que ella, ya seis años antes, ha hecho en On Revolution, acerca del fundamento de la experiencia política moderna republicana y sus instituciones. Nuestro recorrido presentará a) el conflicto conceptual implicado en la desobediencia civil y su deslinde respecto de otros fenómenos políticos contiguos, como son la objeción de conciencia y el derecho a resistencia. En segundo lugar, abordaremos b) el modo como la problematización de la desobediencia civil permite replantear el sentido mismo de la ley y la Constitución política. Finalmente, estableceremos cómo dicha reformulación c) conduce a la reconsideración de la función y estatuto del contrato social, en tanto revela que la estructura que sostiene una República democrática, está cimentada, al menos en su dimensión más elemental, sobre un pacto horizontal o "˜alianza de los muchos'. | es-ES |
