| dc.description | The principle of renunciation of war established in Article 9 of the Japanese Constitution has historically been interpreted strictly. The present work carries out a brief historical analysis about the consequences and effects derived from that, to later study certain proposals and documents of the Executive that tried an interpretative flexibility, until the discussions on the concepts of "enemy base" and "functions of command and control” that are currently being debated in Japan, from a perspective of International Law and, especially, of the right of self-defense established in the Charter of the United Nations. | en-US |
| dc.description | El principio de renuncia a la guerra establecido en el artículo 9 de la Constitución japonesa ha sido interpretado históricamente de manera estricta. Este trabajo efectúa, primero, un breve análisis histórico acerca de las consecuencias y efectos derivados de aquella interpretación, para luego estudiar ciertas propuestas y documentos del Ejecutivo que intentaron una flexibilización interpretativa. Luego se revisan, desde una mirada del derecho internacional, las discusiones sobre los conceptos de base enemiga y de funciones de mando y control que se debaten actualmente en Japón y, especialmente, se observan los requisitos de necesidad y proporcionalidad relativos al derecho de legítima defensa establecido en la Carta de Naciones Unidas. | es-ES |
