| dc.description | La presente investigación busca identificar los espacios discrecionales que existen en el proceso de determinación de las sanciones ambientales. Para alcanzar el objetivo propuesto, se analizarán todas las etapas que se deben seguir durante la tramitación de un procedimiento sancionatorio ambiental, hasta llegar a la sanción específica que se debe aplicar, incluyendo la ponderación de aquellas circunstancias que permiten modular la infracción. Finalmente, el artículo enfatiza la importancia de distinguir los aspectos discre-cionales de los reglados, en tanto ello incide en una diversa forma de motivar la resolución sancionatoria. | es-ES |
| dc.description | The article intends to identify the discretionary spaces for the agency in the determining environmental sanctions. To this end, it will be analyzed all the steps with-in an environmental sanctioning proceeding, which leads to the final determination of the specific sanction, including the weighting of the aggravating and mitigating circumstances. Finally, the article emphasizes the importance of distinguishing between discretionary and regulated aspects of the process, as they strongly shape the sanctioning resolution's ra-tionale. | en-US |
