Based on epistemological reasons of social and historical nature, the stories of victims and their families describe the infrahuman conditions that young offenders had to endure during their stay at the Institute for Reeducation of Minors “Panchito López”, dependent of the Ministry of Justice and Labor of the Paraguayan State. Subsequently, the considerations of the Inter-American Court of Human Rights divided into two topics are analyzed: the right to personal liberty and the duty to adopt provisions in domestic law and the right to judicial guarantees; finally, it concludes with a critique of the institutions founded under a tutelary model that does not recognize children and adolescents as subjects and holders of rights.Fundado en razones epistemológicas de carácter histórico y social, desde los relatos de víctimas y sus familiares se describen las condiciones infrahumanas que debieron soportar los jóvenes infractores de ley durante su estadía en el Instituto de Reeducación del Menor «Panchito López», dependiente del Ministerio de Justicia y Trabajo del Estado paraguayo. Posteriormente, se analizan las consideraciones de la Corte Interamericana de Derechos Humanos en dos tópicos: el derecho a la libertad personal y el deber de adoptar disposiciones de derecho interno y derecho a las garantías judiciales. Finalmente, se concluye con una crítica a las instituciones fundadas bajo un modelo tutelar que no reconoce a los niños, niñas y adolescentes como sujetos y titulares de sus derechos.
