| dc.description | The author examines the various arguments that have been raised concerning the proper meaning and scope of Article 96 of the Organic Law of the Comptroller General of the Republic, on expiry of the repairs that are accounting history of the Judgment of Account . In particular we analyze the role of notification of repair as essential action to give effect and prevent the expiration of accounting charges made by the Comptroller. The position taken in this paper proposes that this matter must be determined according to the rules and principles of administrative procedure provided by the Law No. 19.880, howsoever the repair is an act of an administrative nature. | en-US |
| dc.description | El autor examina los diversos argumentos que se han planteado acerca del correcto sentido y alcance del artículo 96 de la Ley Orgánica de la Contraloría General de la República, en materia de caducidad de los reparos contables que son el antecedente de los Juicios de Cuenta. En particular se analiza el papel que juega la notificación del reparo como actuación esencial para dar eficacia e impedir la caducidad de los cargos contables formulados por la Contraloría. La posición sostenida en este trabajo plantea que esta materia debe dilucidarse conforme a las normas y principios de procedimiento administrativo que aporta la Ley N°19.880, como quiera que el reparo es un acto de naturaleza administrativa. | es-ES |
