Las nuevas tecnologías y la Globalización han fomentado el crecimiento exponencial de datos, en consecuencia, frente a la falta de regulación y control, se han producido innumerables fugas y errores de seguridad. Como respuesta a esta problemática, las grandes potencias han estado en continua búsqueda de una solución, habiendo Europa reaccionado de forma mucho más determinada y severa con la GDPR (EU General Data ProtectionRegulation), que su par, los Estados Unidos de América. Desde sus normas, hasta sus ideas, las diferencias entre ambos resultan insalvables, ya que mientras que en Europa se tiene una concepción de protección de datos paternalista y donde la máxima ‘el ciudadano es el propietario de sus propios datos’ es predominante; en EEUU ocurre exactamente lo contrario. Este trabajo estudia las paradojas que se presentan entre ambos sistemas, inquiriendo una posible solución a los problemas que se plantean.New technologies and Globalization have encouraged the exponential growth of data; consequently, in the face of lack of regulation and control, countless leaks and security errors have occurred. In response to this problem, great powers have been continuously searching for a solution, Europe having reacted in a much more determined and severe way with the GDPR (EU General Data Protection Regulation) than its counterpart, the United States of America. From their rules to their ideas, the differences between the two are insurmountable: while in Europe there is a conception of paternalistic data protection and where the maxim 'citizens are owners of their own data' is predominant; in the USA the exact opposite happens. This paper studies the paradoxes that arise between both systems, demanding a possible solution to the problems contemplated.
