La necesidad de hacer frente a las nuevas realidades sociales relacionadas con las tecnologías es fundamental para avanzar como sociedad; sin embargo cuando este avance implica poner en riesgo la privacidad o intimidad de los miembros de ésta, la pregunta que cabe realizarse es ¿prima la seguridad para eventuales inicios de investigaciones delictuales o prima la intimidad? La protección legal de la privacidad busca resguardarla frente a una variedad de actividades y prácticas que resultan problemáticas, dañinas o lesivas para ella. Pero, ¿no hay, fuera del interés estatal (legítimo) en el control de la delincuencia, otros intereses que debieran ser objeto de consideración? En el presente trabajo se justifica que lo que se ha de buscar no es entorpecer el desarrollo tecnológico, sino que normar de manera adecuada la utilización de estos medios. | es-ES |
