Generally, conflicts between privacy and vigilance are produced with the intervention of several individuals. Nevertheless, there are many solutions to solve the problem of the collective-actions attribution or imputation (Zurechnung / imputatio), from different areas of the law system. On the one hand, there are two solutions: the responsibility of legal persons and the objective responsibility system. In our opinion, both were created in order to demand responsibility (compensation) in certain cases of imputation (difficult to define), so that the victim’s heritage is not diminished. On the other hand, Criminal Law used to have only one solution for this group of cases: the co-perpetration and participation theories. Nevertheless, nowadays it has recently been introduced in Chilean Criminal Law the criminal responsibility of legal persons. Both solutions coexist within the Criminal Law System, which is not, at least apparently, coherent. We seek to clarify the problem and the differences between the different theories of co-perpetration, through another paradigm, so that collective and individual actions could be observed and valued according to their own nature but distinguishing two problems within the action theory: one ontological, and the other epistemological. One of the contemporary theories of criminal law doctrine (Strafrechtsdogmatik) that we believe would allow us to reach this objective is the Theory of Imputation (Theorie der Zurechnung) proposed by Joachim Hruschka. We suggest, therefore, a development of this theory in order to understand coherently the problem of collective actions.Los conflictos entre privacidad y vigilancia por regla general se producen con la intervención de muchos individuos. Sin embargo, no existe una solución única en las distintas áreas del Derecho para resolver el problema de la imputación o atribución (Zurechnung / imputatio) de las acciones colectivas. Por una parte, existen las soluciones de la responsabilidad patrimonial de las personas jurídicas y de la responsabilidad objetiva. A juicio nuestro, ambas fueron creadas para poder exigir responsabilidad en ciertos casos de imputación (aquellos que son difíciles de definir), de modo que el patrimonio de la víctima no se vea mermado. Por otra parte, en el Derecho Penal solía existir sólo una solución para este grupo de casos: las teorías de coautoría y de participación. No obstante, en nuestros días se ha introducido en el Derecho Penal chileno la responsabilidad penal de las personas jurídicas. Ambas soluciones conviven dentro del sistema jurídico penal, lo que no es, aparentemente al menos, coherente. Buscamos clarificar el problema y las diferencias entre las distintas teorías acerca de la coautoría, a través de un paradigma distinto, de modo tal que las acciones colectivas y las individuales se observen y valoren según su propia naturaleza, pero distinguiendo a la vez el plano ontológico del epistemológico. Una de las teorías contemporáneas de la dogmática jurídico-penal (Strafrechtsdogmatik) que estimamos que permitiría alcanzar dicho objetivo es la Teoría de la Imputación (Theorie der Zurechnung) propuesta por Joachim Hruschka. Sugerimos, por tanto, un desarrollo de dicha teoría para comprender de modo coherente las acciones colectivas
