The purpose of this paper is to expose and systematize the considerations and reasoning of the judgements of different courts (Supreme Court of Chile, Court of Appeal of Santiago, Constitutional Court and Council for Transparency) regarding cases in which there has been discussion about the Legal category of "expectations of privacy". To carry out the above, we will distinguish the contexts of the cases in which the application of this concept has been analyzed and how it has been applied to dictate the respective judgements. The cases that will be reviewed refer to different topics, such as Surveillance (surveillance balloons and drones); recordings with hidden cameras; and institutional emails from public officials. This distinction will help to clarify the meaning and scope that the different courts grant to the legal category of "Expectations of Privacy". Finally, the conclusions of this paper are presented.El trabajo que se propone tiene por objetivo exponer y sistematizar las consideraciones y los razonamientos de las sentencias de distintos órganos jurisdiccionales (Corte Suprema, Corte de Apelaciones de Santiago, Tribunal Constitucional y Consejo para la Transparencia) respecto a casos en los que se ha discutido sobre la categoría jurídica de “Expectativas de Privacidad”. Para llevar a cabo lo anterior, se distinguirá cuáles han sido los contextos de los casos en que se ha analizado la aplicación de dicho concepto y cómo se ha aplicado el mismo para dictar las respectivas sentencias y resolver los problemas presentados. Los casos que se revisarán hacen referencia a distintas temáticas, tales como Vigilancia (globos de vigilancia y drones); grabaciones con cámaras ocultas; y correos electrónicos institucionales de funcionarios públicos. Esta distinción ayudará a precisar el sentido y alcance que los distintos órganos jurisdiccionales le otorgan a la categoría jurídica de “Expectativas de Privacidad”. Por último, se presentan las conclusiones de este trabajo.
