The discussion about the use of force in Iraq has raised important questions about the role of international law in the context of major international conflicts. We maintain that the multilateral order was in question before the events in Iraq. The reason was not the purpose of altering the institutional regime of the international community, but the fact that those who held power opted for the historical constant of intervening by their sole decision in a situation of importance that affected them. The questions that then arise will be related to whether the North American action has violated the Charter of the United Nations, whether the intervention can be considered humanitarian or legitimate defense through a preventive attack, as well as the need for reform and reinvention of organizations such as the United Nations.La discusión habida acerca del uso de la fuerza en Irak ha planteado importantes preguntas sobre papel del derecho internacional en el contexto de los grandes conflictos internacionales. Sostenemos que el orden multilateral estaba cuestionado desde antes de los acontecimientos de Irak. La razón fue no el propósito de alterar el régimen institucional de la comunidad internacional, sino el hecho de que quienes detentaban el poder optaron por la constante histórica de intervenir por su sola decisión en una situación de importancia que los afectaba. Las preguntas que surgen entonces estarán relacionadas a si la acción norteamericana ha violado la Carta de las Naciones Unidas, si la intervención puede considerarse de carácter humanitario o bien una legítima defensa a través de un ataque preventivo, como también la necesidad de reforma y reinvención de organismos como las Naciones Unidas.
