| dc.description | The Mining Integration and Complementation Treaty between Chile and Argentina, was signed in 1997, and it’s Complementary Protocol of 1999, entered into force in 2000. Its provisions give rise to a new framework for the development of mining activities in neighboring border areas, and establish a special arrangement for the operation of mining projects that have projections in both countries. Among the fundamental principles of this Agreement, stand out that of national treatment within the scope of application for investors of origin of the other Party, the creation of an area of operations across the border, which requires Additional Specific Protocols, the possibility to establish transnational easements and the possibility of accessing natural resources in the other country. The Mining Treaty constitutes an economic instrument, at the same time that it creates the legal bases for cross-border mining. | en-US |
| dc.description | El Tratado de integración y Complementación Minera entre Chile y Argentina, suscrito en 1997, y su Protocolo Complementario de 1999, entró en vigor en 2000. Sus disposiciones dan lugar a un nuevo marco para el desarrollo de actividades mineras en zonas fronterizas vecinas, y establecen un esquema especial para el funcionamiento de proyectos mineros que tienen proyecciones en ambos países. Entre los principios fundamentales de este Tratado, destacan el del trato nacional dentro del ámbito de aplicación para inversionistas de origen de la otra Parte, la creación de un área de operaciones a través de la frontera, lo cual requiere de Protocolos Específicos Adicionales, la posibilidad de constituir servidumbres transnacionales y la posibilidad de acceder a recursos naturales en el otro país. El Tratado Minero constituye un instrumento económico, al mismo tiempo que crea las bases jurídicas para la minería transfronteriza. | es-ES |
