| dc.description | El objetivo principal de este estudio, es definir el lugar que ocupan los elementos objetivos y subjetivos en la definición de la agresión. Desde un punto de vista político la mayor o menor importancia que se le asigne a estos elementos desembocará en un nuevo análisis de las condiciones de la agresión como su constatación. En cambio, la preferencia de uno de los elementos nos conducirá jurídicamente a problemas relacionados con el fundamento de la responsabilidad y con la naturaleza y extensión de la interpretación. La preponderancia del elemento objetivo o subjetivo en la definición de la agresión nos va a conducir en una dimensión estrictamente jurídica, a una serie de problemas que se relacionan con el fundamento de la responsabilidad internacional y que afectan de alguna manera a la naturaleza de la interpretación. Finalmente, se propone el criterio de la gravedad como una forma de aprehender de “manera objetiva” el elemento subjetivo, la intención agresiva. | es-ES |
| dc.description | The main objective of this paper is to define the place occupied by objective and subjective elements in the definition of aggression. From a political point of view, the greater or lesser importance that is assigned to these elements will lead to a new analysis of the conditions of the aggression and its verification. Instead, the preference for one of the elements will lead us legally to problems related to the basis of liability and the nature and extent of the interpretation. The preponderance of the objective or subjective element in the definition of aggression will lead us, in a strictly legal dimension, to a series of problems that are related to the basis of international responsibility and that affect in some way the nature of the interpretation. Finally, the criterion of gravity is proposed as a way of apprehending in an “objective way” the subjective element, the aggressive intention. | en-US |
