Patents on drugs are currently highly questioned, especially when they refer to drugs that are used to cure diseases in some southern countries of the world. There are two legitimate but conflicting interests in this regard: on the one hand, there is an interest in promoting medical and pharmaceutical research and the development of new drugs, the basis of the patent system; on the other, countries whose populations have a high incidence of some diseases are interested in having low-cost drugs available. The issue has been tackled within the framework of the World Trade Organization. The solution found so far, first with the Doha Declaration and then with a decision of the WTO General Council, seems to be a transitional solution between the two interests at stake.Las patentes sobre medicamentos son muy cuestionadas en la actualidad, sobre todo cuando se refieren a fármacos que sirven para curar enfermedades en algunos países del sur del mundo. Existen al respecto dos intereses legítimos pero contrapuestos: por un lado, está el interés en promover la investigación médica y farmacéutica y el desarrollo de nuevos medicamentos, base del sistema de patentes; por el otro, a los países cuya población que tienen una alta incidencia en algunas enfermedades les interesa poder disponer de medicamentos de bajo costo. El tema ha sido enfrentado en el marco de la Organización Mundial de Comercio. La solución encontrada hasta el momento, primero con la Declaración de Doha y luego con una decisión del Consejo General de la OMC, parece ser una solución de transición entre ambos intereses en juego.
