| dc.description | El presente artículo propone la mitigación del cambio climático como un principio integrante de nuestro ordenamiento jurídico. De lo anterior se colige que la mitigación del cambio climático se posiciona jurídicamente como un parámetro de actuación de la Administración y, correlativamente, como parámetro de control judicial de la misma. En este sentido, al margen de una futura Ley Marco sobre Cambio Climático, proponemos una delimitación conceptual y dogmática de la mitigación del cambio climático, que la incorpore como un elemento inherente a la garantía constitucional del artículo 19 número 8, en especial a propósito del deber de asegurar un medio ambiente libre de contaminación. Así, la necesidad de adoptar medidas de mitigación sobre el cambio climático alcanzaría diversas esferas de nuestro ordenamiento, tales como su incorporación al Sistema de Evaluación de Impacto Ambiental. | es-ES |
| dc.description | This article proposes the mitigation of climate change as an integral principle of our legal system. It follows that climate change mitigation is legally positioned as a parameter of the Administration's performance and, correspondingly, as a parameter of judicial control of the same. In this sense, apart from a future Framework Law on Climate Change, we propose a conceptual and dogmatic delimitation of climate change mitigation, which incorporates it as an element inherent in the constitutional guarantee of article 19 number 8, especially regarding the duty to ensure a pollution-free environment. Thus, the need to adopt mitigation measures on climate change would reach various areas of our system, such as its incorporation into the Environmental Impact Assessment System. | en-US |
