En el último decenio, los tribunales de justicia chilenos han cambiado drásticamente la manera de fallar las controversias que les son planteadas. Se ha visto un cambio generacional de los ministros que componen los tribunales superiores del Poder Judicial, y estos jueces han adoptado posiciones más disruptivas frente a los pleitos que conocen. En este sentido, los tribunales en la actualidad se mueven hacia a la consagración de una pluralidad de fuentes del derecho, en la que la solución de la controversia no se baste en un juego exegético de normas, sino que también integre factores extralegales, sociales y valorativos.In the last decade, Chilean Courts of Justice have drastically changed the way in which the disputes raised before them are judged. There has been a generational change of the judges that comprise the higher courts of the judiciary, and these judges have adopted more disruptive positions regarding the cases they review. In this vein, the courts are currently moving towards the consecration of a plurality of sources of Law, in which the solution of the dispute is not only based on an exegetical set of rules, but also integrates extralegal, social, and value factors.
