| dc.description | This article examines the regulation of stop and search proceedings in Chile, as contained in Article 85 of the Criminal Procedure Code and in Article 12 of Law 20.931, both in its current formulation and in the proposal for legal reform presented in 2019 by President Sebastián Piñera, in order to analyse their conformity with the international obligations binding on Chile and included in several human rights treaties. The article explains that the current regulation and the proposal for extension of police powers amount to a violation of the guarantees of personal liberty and freedom of movement, privacy and non-discrimination, as well as the specific guarantees that protect the rights of children and adolescents. | en-US |
| dc.description | Este artículo examina la regulación del control de identidad en Chile recogido en el artículo 85 del Código Procesal Penal y en el artículo 12 de la Ley 20.931, tanto en su formulación actual como en la propuesta de reforma legal presentada por el presidente Sebastián Piñera en el año 2019. El objetivo es analizar su conformidad con las obligaciones internacionales adquiridas por Chile en diversos tratados de derechos humanos. El artículo explica que la regulación actual y la propuesta de ampliación de las facultades policiales suponen una vulneración de las garantías de libertad personal y libertad de movimiento o circulación, privacidad y no discriminación, como también las garantías particulares que protegen los derechos de niños, niñas y adolescentes. | es-ES |
