La ley Nº 20.016/2005, introduce una serie de modificaciones al artículo 18 de la LGUC, en particular, en cuanto ha venido a diferenciar tanto los elementos de la construcción cuyo vicio puede causar un daño, como los plazos dentro de los cuales se puede hacer efectiva la responsabilidad de los profesionales de la construcción. Por ello por una parte, primeramente, se pretende realizar un esbozo histórico de la regulación que ha dado la LGUC a la responsabilidad de los profesionales de la construcción. Para, a continuación, intentar determinar el alcance de los nuevos plazos (decenal, quinquenal y trienal) que se han fijado para hacer efectiva esta responsabilidad. Y, en tercer lugar, tratar de delimitar en qué consiste cada uno de los elementos de la construcción cuyo vicio (falla o defecto) pueden causar un daño o perjuicio que debe ser reparado.Law # 20.016-2005, modifies in several ways the 18th article of the LGUC, particularly, when it distinguishes both the different elements of construction that may cause a damage and the different terms in which the responsibility of the professionals of constructions may be made effective.
