Pese a ser los municipios los responsables constitucionales de la ordenación de su territorio, la competencia de la Nación para otorgar títulos de aprovechamiento minero es uno de los principales límites que afrontan los entes locales en el ejercicio de su competencia, así como uno de los mayores focos de confl ictividad entre estos dos niveles administrativos. En un fallo reciente, la Corte Constitucional consideró contrario a la Constitución que se marginara completamente a los municipios del proceso de otorgamiento de los títulos mineros y efectuó una interpretación de la legislación minera que obliga a que se tenga en cuenta su opinión en estos trámitesIn spite of the fact that the duty to regulate land use within their jurisdiction was vested upon local authorities by Constitution, the control of the central government over the mining industry represents one of the principal limits that the municipalities have to face while exercising their powers over the territory. Such a situation leads to many conflicts between these two administrative levels. In a recent decision, the Constitutional Court struck down a statutory provision that excluded completely the participation of municipalities in the procedures of granting the right to work on mines and ruled, in turn, that this kind of procedures have to take into account the considerations of the local authorities.
