Abstract
Este trabajo se analiza si se justifi ca, en el contexto de la Constitucionalización del derecho, un tratamiento igualitario del daño ambiental consecutivo frente a los daños generales dentro del sistema de responsabilidad administrativa del Estado. Teniendo en cuenta las características específi cas del daño ambiental se hace necesario redefi nir el tratamiento dado a la responsabilidad el Estado por daños ambientales impuros, principalmente en cuanto al título de imputación. Es necesaria tal redefi nición, pues, tal como se encuentran hoy los regímenes de responsabilidad del Estado no evidencian una protección reforzada en cuanto al patrimonio de las víctimas frente a dichas afectaciones, pero sí brindada al medio ambiente propiamente dicho con ocasión al fenómeno de la Constitucionalización del derecho, ya que, el Estado actúa como administrador de los bienes colectivos. En ese sentido se propone redefi nir los títulos de imputación en materia de daños ambientales consecutivos reconocidos por la jurisprudencia de la jurisdicción de lo contencioso administrativo, en especial del Consejo de Estado Colombiano This article analyzes if it is justifi ed in the framework of the Constitutionalisation of the law an equal procedure for the consecutive environmental damage against the general damages inside the system of administrative responsibility of the State. In consideration of the characteristics of the environmental damage, it is necessary redefi ne the judgment given to the State Responsibility for the impure environmental damage, mainly by the title of the imputation. This redefi nition is necessary in reason the regimes of the state responsibility of the law do not show the reinforced protection about the heritage of the victims against their pretentions but well provided to the environment. To be more exactly, with the phenomenon of the Constitutionalisation of the law the State acts like the administrator of the collective assets. This is the reason why it is proposed redefi ne the titles of imputation on the consecutive environmental damage aspects discussed by the Jurisprudence of the contested administrative decision
