| dc.description | The purpose of this work is to present the challenges to the regulation of the banking activity, which can range from the different phases of a national economy to non-financial factors that cannot be controlled by the respective national legislation, and that affect the decision-making underlying the banking regulation. These challenges will be illustrated by presenting the legislative reactions in Chile to two specific economic junctures: (i) the Chilean debt crisis of 1982; and (ii) the world financial crisis of 2008, which ultimately led to the incorporation into Chilean banking regulation of the Basel III proposals. In this context, this paper will focus in the new banking regulator, the Financial Market Commission, and the amendments to the General Banking Act. | en-US |
| dc.description | El propósito de este trabajo es explicar los desafíos presentes al regular la actividad bancaria, los cuales pueden variar desde las distintas etapas de la economía de una nación hasta factores no financieros que no pueden ser controlados por la respectiva ley nacional, y que pueden afectar la toma de decisiones subyacente a la regulación bancaria. Estos desafíos serán ilustrados por medio de la explicación de las reacciones legislativas en Chile a dos conyunturas económicas específicas: (i) la crisis chilena de endeudamiento de 1982; y (ii) la crisis financiera mundial de 2008, la que condujo en último instancia a la incorporación de las propuestas de Basilea III en la regulación bancaria chilena. En este contexto, este artículo se enfocará en el nuevo regulador bancario, la Comisión para el Mercado Financiero, y en las reformas a la Ley General de Bancos. | es-ES |
