| dc.description | The recognition and protection of human rights is one of the fundamental pillars of the rule of law, this idea brings endless effects in our legal system, however, this time we will highlight only that which relates to the principle of constitutional supremacy, which means that any lower norm, and in general, all public policy must be in harmony with our constitution, therefore, every public policy should respect human rights. Specifically, this article will address three problematic aspects of Chilean criminal policy, first, analyze the processes of primary and secondary criminalization, then spell out some negative effects of the prison institution, and finally some criticism will be made to the model of citizen security both in a global level and a local level. | en-US |
| dc.description | El reconocimiento y protección a los Derechos Humanos es uno de los pilares fundamentales del Estado de Derecho, esta idea trae aparejado un sin fin de efectos en nuestro ordenamiento jurídico. Una de sus consecuencias dice relación con el establecimiento del principio de supremacía constitucional, el cual se traduce en que toda norma inferior, y en general, toda política pública, debe estar en armonía con las normas Constitucionales y con el respeto a los derechos humanos de todos los ciudadanos. En este trabajo se abordaran tres aspectos problemáticos de la implementación de la política criminal chilena. En primer lugar, se analizan los procesos de criminalización primaria y secundaria. Posteriormente, se enuncian algunos efectos negativos de la institución carcelaria, y finalmente se sostienen algunas críticas al modelo dominante de seguridad ciudadana tanto a nivel global como en los espacios locales. | es-ES |
