| dc.description | The study approaches an aspect of the relation of the Chilean State with the Mapuche people, as he is the one of the legal entail. It is the question of configuration of a forged legal institutionality from the center of the Republic and that one projected on the territory and population Mapuche that we denominated as legal expansionism. The nineteenth-century legal norm, that marked the beginning of this process, is that one created the province of Arauco. The Chelean advance on Mapuche's land that legitimized this law is examined here through its penal reality. | dc.description | El estudio aborda un aspecto de la relación del Estado chileno con el pueblo mapuche, como es el de la vinculación jurídica. Se trata de la configuración de una institucionalidad legal forjada desde el centro de la República y que se proyectó sobre el territorio y población mapuche, que denominamos como expansionismo jurídico. La norma legal decimonónica, que marcó el inicio de este proceso, es aquella que creó la provincia de Arauco. El avance "chilenizador" sobre tierras mapuche, que legitimó esta ley, es examinada aquí a través de su realidad penal. En concreto se estudia el orden jurídico-penal establecido y la realidad criminal que es posible visualizar en las últimas décadas del siglo XIX en este espacio fronterizo. | es-ES |
