| dc.description | This article examines the applicability of the notion of ideology in the legal domain, by using as its context the transformations that are currently taking shape in Chile with respect to the recognition of sexual diversity. After sketching the existence of divergent ideologies about the relation between genitalia and gender identity, the author offers a taxonomy of the modalities of judicial reasoning concerning gender identity that exist in the Chilean case law on requests presented by trans people for the change of their name and their registered sex. These modalities of judicial reasoning both reveal the existence of ideological disputes in the field of gender identity, and evince the significance that ideologies bear on the fulfillment of the jurisdictional function. | en-US |
| dc.description | El presente artículo examina la aplicabilidad de la noción de ideología en el plano del derecho, empleando como contexto las transformaciones que en materia de reconocimiento de la diversidad sexual están actualmente ocurriendo en Chile. Tras delinear la existencia de ideologías divergentes sobre la relación entre genitalidad e identidad de género, el autor ofrece una taxonomía de las modalidades de razonamiento judicial sobre identidad de género existentes en la jurisprudencia chilena respecto a solicitudes de cambio de nombre y de sexo registral presentadas por personas trans. Estas modalidades de razonamiento judicial evidencian la existencia de disputas ideológicas sobre identidad de género y delatan la importancia que, en el desempeño de la función jurisdiccional, detenta la ideología. | es-ES |
