| dc.description | The Legal Theory has not yet developed the study of the antinomies between normative statements which do not posses deontic modalities, for this reason this paper focuses on describing and analysing the notion of antinomies and their conditions of occurrence between these normative statements. In order to undertake this task, P.F. Strawson's notion of inconsistency is used, thereafter different delimiting criteria for antinomies between normative statements are developed and exemplified, and finally those criteria could be linked to antinomies' occurrence conditions. Hence, it is possible to obtain a first proposal capable of contributing to the study of the antinomies among normative statements lacking deontic modalities which exist in the legal systems. | en-US |
| dc.description | El estudio de las antinomias entre enunciados normativos que no poseen una modalización deóntica aún no ha sido desarrollo de manera suficiente por la Teoría del Derecho. Por ende, el presente artículo se propone describir y analizar la noción de antinomias y sus condiciones de ocurrencia entre este tipo de enunciados normativos. Para realizar este propósito se utiliza la noción de inconsistencia propuesta por P.F. Strawson, y a partir de ella se desarrollan y ejemplifican diversos criterios de identificación de las antinomias entre estos enunciados normativos, para luego vincular estos criterios con las condiciones de ocurrencia de las antinomias. Así, se obtiene una primera propuesta capaz de contribuir en el estudio de las antinomias entre los enunciados normativos sin modalización deóntica, integrantes de los sistemas jurídicos. | es-ES |
