| dc.description | This paper aims to analyze the problem of administrative sanctions from the categories of the Regulatory haw. The author argues that the activity of the regulatory does not constitute a new function of the public Administration. On the contrary, there is an overlap on traditional concepts such as police and public service, but supported by other grounds: techniques of intervention before market's failures. With such a purpose, the administrative sanctions are assessed according to the criteria of the doctrine of the Regulation, which includes many principles already contained in our law. | en-US |
| dc.description | Este trabajo tiene por objeto analizar el problema de las sanciones administrativas a partir de las categorías del denominado Derecho regulatorio. El autor sostiene que la actividad regulatoria de la Administración no constituye una nueva función, sino que se superpone a los conceptos tradicionales de actividad de policía y servicio público, pero proyectada desde otra perspectiva: como técnicas de intervención ante las fallas del mercado. Con tal objeto, hace una evaluación de nuestro régimen sancionador administrativo en Chile a partir de los criterios que aporta la doctrina de la regulación y sostiene que muchos de ellos ya se encuentran positivizados en nuestro Derecho. | es-ES |
