In some Latin American countries, such as Mexico, a system of judicial binding precedents has been established under the name of "jurisprudencia" (jurisprudence), as has occurred with the precedents of the Inter-American Court of Human Rights, This jurisprudential system had its origins in the Common Law stare decisis, especially in North American Common Law, It has been adapted to the particularities of each country and has as its premise the search for judicial certainty for the person awaiting trial, However, this work addresses the problem of the autonomy and the independence of the trier, when he has to issue sentences following judicial precedents that have become binding jurisprudence, in such a manner that the inferior courts are bound to the interpretation criterion of the higher courts.En algunos países latinoamericanos —como es el caso de México—, se ha adoptado un sistema de obligatoriedad de los precedentes judiciales bajo la denominación de jurisprudencia, como incluso ha sucedido con los precedentes de la Corte Interamericana de Derechos Humanos, Este sistema jurisprudencial tuvo su origen en el stare decisis del Common Law, sobre todo norteamericano, adaptándose a las particularidades de cada país y teniendo como premisa la búsqueda de certeza jurídica para el justiciable, Sin embargo, en este trabajo se plantea como problema para la autonomía e independencia del juzgador, el tener que emitir sus sentencias siguiendo los precedentes judiciales que han llegado a conformar jurisprudencia, de tal manera que los tribunales inferiores se encuentran supeditados a los criterios interpretativos de los de mayor jerarquía.
