| dc.description | This article offers an answer to the question: under which definition of science is the study of positive law a science? In accomplishing its purpose, the author criticizes the understanding of law as a “sui generis” discipline and the related idea that the dilemmas faced by the Legal Doctrine are, by definition, only of domestic implications and interest. Instead, it is claimed that, as well as all scientific propositions, whether from exact, natural or social sciences or humanist studies, the propositions of Legal Theory are scientific, when verifiable. Verifiability in turn, depends on a) the discussion on positive national law being related to a general legal problem that surpasses the singularities of national jurisdictions; b) the degree to which the discussion has been exposed to examination by the specialists community able to exert a verification judgment; and c) the size of such an experts community. | en-US |
| dc.description | El presente artículo propone una respuesta a la pregunta ¿bajo qué definición de ciencia es el estudio del derecho positivo una ciencia? Para ello, critica la concepción del derecho como disciplina sui generis, y la idea, relacionada con la anterior, de que los problemas de la doctrina jurídica son por definición de alcance e interés solamente nacionales. Se sostiene, en cambio, que como todas las proposiciones científicas, trátese de las ciencias exactas, naturales, sociales o las humanidades, las proposiciones de la dogmática son científicas cuando son verificables. La verificabilidad, a su turno, depende de a) que la discusión del derecho positivo nacional sea conectada con algún problema jurídico general que trascienda las peculiaridades de las jurisdicciones nacionales, b) el grado de exposición de esa discusión a la revisión por parte de la comunidad de especialistas que está en condiciones de ejercer un juicio de verificación, y c) el tamaño de esa comunidad de expertos. | es-ES |
