This paper addresses the important topic of notarial instructions. Due to the complexity of modern contracts, the larger number of parties involved on them and the increasing amounts of the businesses, it has become that along with the subscription of the main contract the parties grant instructions to the notary for the most diverse purposes, without being such instructions circumscribed —as it was the case— only to the payment of the price to the seller upon fulfillment of certain requirements (e.g., inscription on the Real Estate Registry). Hence the need for clarifying, among other issues, its legal nature, evidentiary weight, binding force and limits.Este artículo aborda la importante cuestión de las instrucciones notariales. Debido a la complejidad de los contratos modernos, el mayor número de partes que intervienen en los contratos y la creciente cuantía de los mismos, se ha vuelto común que junto con la suscripción del contrato principal las partes otorguen instrucciones al notario para los más diversos efectos, no circunscribiéndose actualmente esas instrucciones —como era usual— solo a la entrega del precio al vendedor cuando se cumplen determinados requisitos (por ejemplo, inscripción en el Conservador de Bienes Raíces). De ahí la necesidad de clarificar su naturaleza jurídica, valor probatorio, carácter vinculante y límites.
