| dc.description | In the Chilean constitutional judicial system the Constitutional Court and the ordinary courts protect and give meaning to fundamental rights. This dual system of constitutional jurisdiction has resulted in the existence of different approaches and levels of protections of the rights involved. Dual constitutional jurisdiction violates the value of legal certainty and the Constitution's equal protection clause. In this article the author explains the sources of this problem and proposes lege data and lege ferenda solutions to achieve more certainty and equality in the judicial protection of fundamental rights of citizens. | en-US |
| dc.description | En el sistema chileno de jurisdicción constitucional tanto el Tribunal Constitucional como la judicatura ordinaria tutelan y configuran interpretativamente los derechos fundamentales de las personas. La experiencia de este sistema dual de jurisdicción de las libertades ha demostrado que los derechos fundamentales son tutelados y configurados de un modo diverso. Esa dualidad genera incerteza jurídica y afecta a la garantía de la igualdad de los ciudadanos frente a la Constitución. En el presente trabajo el autor fundamenta las causas de este problema y sugiere, de lege lata y lege ferenda, posibles caminos que aseguren una mayor certeza e igualdad en la tutela jurisdiccional de los derechos fundamentales de los ciudadanos. | es-ES |
