| dc.description | This paper refers to genetic testing in the workplace. From the perspective of the worker´s fundamental rights, genetic testing is debatable. It provides information that is relevant for the prevention of labour-related risks and thus contributes to the protection of the worker´s rights to life and limb and mental health. However, genetic testing may violate the worker´s rights of privacy and to non-discriminatory treatment. Also, it is necessary to assess the effects of genetic testing in the rights of other right-holders, like the employer and the State. Considering the lack of specific legislation on this matter in Chile, the author, building on the ex-isting law on fundamental rights, proposes some ways of protecting and integrating these rights. | en-US |
| dc.description | Este trabajo se ocupa de las exploraciones genéticas en el ámbito laboral. Desde la perspectiva de los derechos fundamentales del trabajador, el uso de los análisis genéticos resulta ambivalente: ofrece información relevante para la prevención de riesgos laborales, lo cual favorece la protección del derecho a la vida y a la integridad física y psíquica del trabajador; pero puede lesionar su derecho a la intimidad y su derecho a no ser discriminado. Además, involucra intereses y derechos de otros titulares, como el empresario y el Estado, que es preciso articular. A falta de legislación que establezca un sistema específico de garantías, se desbrozan algunas vías a través de las cuales se podría instrumentar esa protección y articulación de derechos, a partir de una relectura en clave de efectividad de los derechos fundamentales del ordenamiento jurídico vigente. | es-ES |
