This article analyzes the tutela laboral from the perspective of its design and its operation, in order to verify whether it could be characterized as a channel for direct enforcement of the Constitution and ensuring the immediate horizontal efficacy of workers' fundamental rights, as part of the doctrine and case law (jurisprudence) has done it. The analysis outcomes shows that the protection of fundamental rights of workers through the tutela laboral is mediated by law: employment protection is a channel of indirect enforcement of the Constitution and guarantees mediate horizontal efficacy of fundamental rights. However, this result does not mean denying effect to the principle of constitutional supremacy in the context of the tutela laboral, because it is possible to understand it otherwise. If the supremacy of the Constitution is understood as the duty of the judge to apply the law in accordance with the Constitution, then there is an explanation of this principle that is consistent with the design and operation of the tutela laboral.En este artículo se analiza la tutela laboral desde la perspectiva de su diseño y de su funcionamiento, con el propósito de verificar si efectivamente responde a la caracterización que parte de la doctrina y de la jurisprudencia han hecho de ella, en cuanto cauce de aplicación directa de la Constitución y garantía de la eficacia horizontal inmediata de los derechos fundamentales de los trabajadores. Los resultados del análisis demuestran que la protección de los derechos fundamentales de los trabajadores a través de la tutela laboral está mediatizada por la ley: la tutela laboral es un cauce de aplicación indirecta de la Constitución y garantiza un efecto horizontal mediato de los derechos fundamentales. Sin embargo, este resultado no significa negarle vigencia al principio de supremacía constitucional en el contexto de la tutela laboral, porque cabe la posibilidad de entenderlo de otra manera. Si la supremacía de la Constitución se entiende como el deber del juez laboral de aplicar el Derecho conforme a la Constitución, entonces hay una explicación de este principio que es consistente con el diseño y funcionamiento de la tutela laboral.
