| dc.description | This article aims to set out some theoretical and methodological reformulations about “static” analysis of judicial precedents. The purpose is to review the explanatory “yields” that analytical philosophical observations have had in the practice of using precedents in futures cases. Particular reference will be made to “illocutionary force” and “perlocutionary effects” in the speech acts, in order to differentiate between (i) the ascribing rule that defines and establishes the normative meaning of the juridical statements, and (ii) the analogical rule about following the ascribing rule. As regards to the last, the paper depicts some critical observations against the traditional thinking about the structure of analogical rule in the precedents issue. The paper concludes with some examples that illustrate the defended ideas. | en-US |
| dc.description | Este artículo presenta algunas reformulaciones teóricas y metodológicas acerca del análisis estático de las sentencias judiciales. El objetivo es examinar los rendimientos explicativos que tienen, para la práctica de usar sentencias en casos futuros, algunas observaciones que la filosofía analítica ha propuesto. Especial mención tendrán las ideas de fuerza ilocutiva y efecto perlocutivo de los actos de habla, para diferenciar entre un problema de determinación del significado de una regla que adscribe sentidos normativos a enunciados, por un lado, y un problema de seguimiento analógico de esa regla de adscripción, por el otro. Dentro de esto último, se presentarán algunas observaciones críticas en relación con la estructura tradicional que mueve la extensión de subreglas jurisprudenciales a casos nuevos. El texto cierra con dos ejemplos que intentan presentar el funcionamiento en casos concretos de las ideas sostenidas en toda su extensión. | es-ES |
