| dc.description | The article is a description and a critic of the legal regulation on police interrogation in the Chilean Criminal Procedural Code. In addition, it describes the practices developed to reinstate the use of confessions in criminal procedure after a period in which the police avoided the interrogations. There is also a review of the decisions of the Chilean Supreme Court about the admissibility of confession in criminal trials. Finally, the article discusses the need for a legal reform oriented to clarify the rules about police interrogation, the control of confession admissibility and its presentation on trial, all with the aim to contribute to a better police work and to a better judicial control over confession’s reliability. | en-US |
| dc.description | El trabajo presenta críticamente la regulación de la declaración del imputado frente a la policía en el Código Procesal Penal. Además, describe cuál es el modo en que en la práctica se ha venido reinstalando la interrogación policial después de algún tiempo en que tendió a evitarse. También se revisa la jurisprudencia de la Corte Suprema en cuanto a las condiciones de admisibilidad de las confesiones obtenidas por la policía. Finalmente se plantea la necesidad de una reforma legal con el fin de clarificar el modo en que debe obtenerse la declaración, el control de su admisibilidad y su presentación en el juicio oral, todo con el fin de favorecer un mejor trabajo policial y un mejor control judicial de la confiabilidad de las confesiones. | es-ES |
