dc.description | The research presented in this article shows new empirical data about the use of international human rights law in Chile's Constitutional Tribunal. It identifies, through an analysis of majority and minority votes, different ways of referencing international human rights law: systematic rejection, systematic absence of references, systematic references, and a "cherry-picking approach". This shows that only very few justices consider international human rights law a source of law. After the presentation of the empirical data, the article looks for possible reasons for said differences, based on the analysis of some judgments, interviews with justices, and additional empirical evidence. | en-US |
dc.description | La investigación que se presenta en este artículo revela datos inéditos empíricos sobre el uso del derecho internacional de los derechos humanos por el Tribunal Constitucional de Chile. Identifica, mediante un análisis de votos de mayoría y de minoría, distintas maneras de uso, a saber, rechazo sistemático, no uso sistemático, cita sistemática, y cita selectiva, por parte de los distintos ministros. Se muestra que solamente algunos ministros consideran el derecho internacional de los derechos humanos como fuente de derecho. Posterior a la presentación de los datos empíricos, busca posibles razones que expliquen las diferencias, basado en un análisis de sentencias, entrevistas con ministros, y evidencia empírica adicional. | es-ES |
