The present study inquiries through semistructured interviews with a sample of guarantee and oral judges, about the penological conceptions of the judges and to establish to what extent these would influence the sentencing decision between a prison sentence and an alternative sanction. In addition, it explores their perceptions about the work of controlling the execution of sentences. The findings gave an account of a complex sentencing process in which penological perceptions would have a lesser influence and in which the duty to motivate sentences would have been depleted. In the execution of the sentence arena, the study gives reveals the importance of having tools to control it and the need to have a judiciary dedicated exclusively to the knowledge of this topic.El presente estudio indaga mediante entrevistas semiestructuradas practicadas a una muestra de jueces de garantía y oral, acerca de las concepciones penológicas de los jueces y busca establecer en qué medida estas influirían la decisión de juzgamiento entre una pena de cárcel y una sustitu­tiva. Además, explora las percepciones acerca de la labor de control de la ejecución de las penas. Los hallazgos dan cuenta de un proceso complejo de juzgamiento en donde las percepciones peno­lógicas tendrían una influencia menor y en el que se estaría mermando el deber de motivación de las sentencias. En materia de ejecución penal, por su parte, el estudio revela la importancia de contar con herramientas para su control, y la necesidad de contar con una judicatura abocada exclusivamente al conocimiento de dicha temática.
