| dc.description | The problem of organised crimes is in full expansion inside the criminal law's discipline. Under this concept underlie different crimes manifestation that disagree in their ground of the punishment. The national laws are not coincident, in its conceptualization, with the international one. So, the problem in order to determine their limits increase. It is not the aim of this paper to analyse the ground and the need to punish the offence of criminal conspiracy, but to uncover the different offences in which the component "organization" appears and their resulting problems. | en-US |
| dc.description | La problemática de la criminalidad organizada o del crimen organizado se encuentra en franca expansión en la disciplina penal. Bajo dicho concepto subyacen diversas manifestaciones delictivas que difieren en su fundamento de punición. Las legislaciones nacionales no son coincidentes en su conceptualización con la normativa internacional, por lo que el problema de delimitar su ámbito de aplicación aumenta. No será objeto del presente trabajo analizar el fundamento y la necesidad de punición autónoma de los delitos de pertenencia a una asociación sino poner al descubierto las distintas manifestaciones delictivas en las que está presente el componente "organizacional" y los problemas que ellas acarrean. | es-ES |
