| dc.description | The first part of this paper is a theoretical examination of the so called in rem right on inheritance (“derecho real de herencia”) in which the author considers this legal construct as abstract and scarcely useful when applied to solving practical matters such as legal claims to receive part of an estate and the assignment or transfer of rights in an estate. In the second part the author examines, by attending to current law on transfer of inheritance rights, the fundamentals of this institution, and also the transfer procedure when real property is part of the estate. | en-US |
| dc.description | La primera parte del trabajo es un análisis dogmático del llamado “derecho real de herencia”, en el que se vierte la opinión de la autora respecto de la abstracción de esta figura y de su escasa utilidad para resolver asuntos prácticos como la petición de herencia y la cesión de derechos hereditarios. En la segunda parte se estudia, sobre la base de la legislación vigente relativa a la cesión de derechos hereditarios, la naturaleza de esta institución, así como la forma de realizar la cesión cuando en ella quedan comprendidos bienes inmuebles. | es-ES |
