| dc.description | Considering the current role of both legislation and administrative rulemaking, this paper argues why and for what purposes it is necessary to redefine the understanding of legal reserve clause. Such redefinition regards making operative the legislation-administrative rulemaking relationship, by channeling it through certain means. It is not incompatible with the Chilean Constitution, though it requires that the constitutional court changes its approach to legal reserve cases. | en-US |
