dc.descriptionThis paper assumes that law (including the subsystem of fundamental rights) as well as the so called legal science reconstruct reality through a number of antagonistic and binary relations. The first part reviews the universal/ particular relation and some of the ways it affects the theory of fundamental rights. The second part takes a gender perspective to analyse the importance of the equality/difference binary, when related to the efficacy of women’s fundamental rights. The author states a) that legal norms, through their own institutional construction transfer gender asymmetry sometimes as part of the conditions necessary for the organization of these same norms, and b) that when legal norms do not do that, and on the contrary, express their purpose to oppose gender inequality –as it happens with laws on fundamental rights and specifically with equality laws– these legal norms become inefficient because they are built on the assumption of the notion of abstract individuals. This notion, at the same time, is based on the idea that legal relationships occur between individuals, when in fact the realities of social discrimination and exclusion are best understood as built upon inter-group relationships.en-US
dc.descriptionEste artículo parte de la hipótesis de que tanto el Derecho (incluido el subsistema de derechos fundamentales) como la denominada Ciencia Jurídica reconstruyen la realidad a través de una serie de relaciones antagónicas o binomios. En la primera parte, se estudia la pareja universalidad-particularidad y algunas de sus repercusiones en la teoría jurídica de los derechos fundamentales. En la segunda parte, a partir de un enfoque de género, se analiza la gravitación del binomio igualdad-diferencia en relación con la eficacia de los derechos fundamentales de las mujeres. A los efectos, se postula que: a) las normas jurídicas vehiculan en gran medida a través de sus propias instituciones las asimetrías de género utilizándolas en algunos casos como presupuestos de organización de las mismas, y b) cuando no vehiculan las asimetrías de género y, por el contrario, parecen oponerse a ellas –como ocurre en general con las normas que constituyen el subsistema de derechos fundamentales y especialmente con las normas específicas de igualdad– éstas se tornan ineficaces porque están erigidas sobre la noción nuclear del sujeto abstracto que, a su vez, presupone relaciones jurídicas de carácter intersubjetivo, mientras que los fenómenos de exclusión o discriminación social se construyen, en cambio, sobre relaciones intergrupales.es-ES
