The regime of forestry improvement created by the Chilean Decree-Law N° 701 in 1974, is characterised by: a) the qualification of a land or of a forest already existing, naturally or artificially, as forest or preferably forest, qualification that distinguishes it, from the legal point of view, from other terrains or woodlands for which qualification has not been entreated; b) by their assimilation to a regime of management characterised by premiums and tax exemptions for the owner while he follows the plans approved by the Forestry Service, but which he must return if he does not comply with said plans; and c) by the character of "real" right (jure in re), inscribed in the Registry of Real Estate Property, which the above mentioned assimilation has, and which encumbers the land in the form of a mortgage, irrespective of the owner of it and in spite of the mutations in its ownership. This mortgage, which the author calls a FORESTRY mortgage, as opposed to the voluntary or conventional mortgage ruled by the Chilean Civil Code, and the legal mortgage determined by the Civil Procedure Code suggests, like every new legal institution, certain doubts which professors, doctrine and jurisprudence must clarify. The present work points to the main questions, in the spirit of collaborating to the advancement of a system which is not only an innovation, but is good, and may bring about the renewal and development of the once abundant and productive Chilean forest.El régimen de fomento forestal creado por el Decreto ley N° 701, año 1974, se caracteriza fundamentalmente: a) por la calificación de un terreno como forestal o preferentemente forestal, o la de un bosque ya existente como natural o artificial, calificación que los hace distinguirse, jurídicamente, de otros suelos o arbolados que no la han impetrado; b) por la afectación, indefinida en el tiempo, que aquel terreno o estos bosques tienen a un régimen de aprovechamiento que ofrece al dueño primas de forestación y franquicias tributarias que goza mientras cumple los planes de manejo aprobados por el Servicio Forestal, pero que debe restituir si los infringe; y c) por la condición de derecho real, inscrito en el Registro Conservatorio de Bienes Raíces, que dicha afectación posee y que la hace gravar al predio en forma de una hipoteca, cualquiera que sea el dueño del suelo y pese a las mutaciones de dominio que éste sufra. La hipoteca, que el autor llama FORESTAL, en oposición a la hipoteca voluntaria o convencional, regida por el Código Civil Chileno, y a la hipoteca legal consultada por el Código de Procedimiento del ramo, plantea —como toda institución nueva de derecho— algunas dudas e interrogantes que corresponderá a la cátedra, a la doctrina y a la Jurisprudencia de los Tribunales de Justicia resolver. El presente trabajo enfoca las principales cuestiones con el ánimo de colaborar al perfeccionamiento de un sistema que, amén de novedoso, es bueno, y puede conducir al renacimiento y desarrollo del otrora abundante y productivo bosque chileno.
