El autor describe y analiza jurisprudencia reciente de la Corte Suprema que aborda el problema del cómputo del plazo de prescripción de la acción de responsabilidad extracontractual establecida en el Código Civil chileno, exponiendo las tendencias en la materia y la doctrina nacional y comparada sobre el particular, comentando y reconociendo como acertada doctrina aquella que entiende que el plazo debe contarse desde que todos los elementos de la acción de responsabilidad se encuentran reunidos en el actor, y no sólo desde la perpetración del acto ilícito. The author describes and analyzes a recent case of the Supreme Court of Justice that addresses the problem of the limitation period of the noncontractual liability action established in the Chilean Civil Code, exposing the trends of national and comparative doctrine on the matter, recognizing as the right opinion in this matter the one that understand that the term must be counted from when all the liability action elements are gathered in the plaintiff, and not only since the occurrence of the illegal act.
