Legal challenges about the provision and of water quality regulations in the Province of Buenos Aires in Argentina

dc.descriptionEste artículo analiza la normativa, los estudios científicos y una selección de jurisprudencia sobre la presencia en el agua, en altas concentraciones, de elementos perjudiciales para la salud de origen natural (como el arsénico y el flúor) y de otros generados a partir de actividades antrópicas (nitratos), en un grupo de partidos de la provincia de Buenos Aires en Argentina. La metodología se basó en un diseño de tipo bibliográfico-documental y descriptivo y se ha empleado la hermenéutica jurídica. A partir de todos los documentos analizados es posible destacar las altas concentraciones de arsénico en el área estudiada, y el hecho de que los habitantes afectados iniciaron acciones legales, principalmente debido a su existencia, y que, en este contexto, no siempre fueron considerados el flúor y los nitratos. En relación con la normativa vigente, se advierte que en el territorio bonaerense rigen valores diferentes de arsénico, de flúor y de nitratos que se encuentran legalmente permitidos en la provisión de agua de red: surge la interrogante sobre qué se debería aplicar en la práctica. Esta situación no fue considerada en la jurisprudencia analizada.es-ES
dc.descriptionThis paper analyzes regulations, scientific studies and a selection of jurisprudence connected to the existence of natural elements harmful to health of natural origin (such as arsenic and fluorine) and of other produced by anthropic activities (nitrates) in water in a selection of districts of the Province of Buenos Aires, in Argentina. The methodology was structured in a bibliographical-documental and descriptive design and we applied legal hermeneutics. Considering all analyzed documents, it is possible to assert that there are high levels of arsenic concentrations in water in the studied area, that damaged citizens filed legal actions focusing mainly on its existence and that they did not usually include fluorine or nitrates. In connection with present regulations, we could notice that in the territory of the Province of Buenos Aires different values of arsenic, fluorine and nitrates are legally allowed in the provision of network water, raising the question about which value should be applied in practice. This situation was not considered in the analyzed jurisprudence.en-US
