| dc.description | Este artículo es el resultado de una investigación doctoral sobre la corrección constitucional del derecho familiar aplicado al divorcio. En él se develan las claves interpretativas que comprende el enfoque diferencial de género para víctimas de violencia intrafamiliar. Así, el análisis estático de la sentencia SU-080 de 2020 revela la integración de un incidente de reparación civil a un proceso de divorcio. Esto permite concluir que los jueces de familia deben articular el sistema normativo superior con una visión multinivel del principio pro fémina, para evitar la impunidad del agresor y la revictimización de la mujer por parte del Estado. | es-ES |
| dc.description | This article is a result of doctoral research on the constitutional correction of family law applied to divorce. It reveals the interpretative keys that comprise the differential gender approach for victims of domestic violence. Thus, the static analysis of Judgment SU-080 of 2020, reveals the integration of a civil reparation incident, to a divorce process. This allows us to conclude that family judges must articulate the superior regulatory system, with a multilevel vision of the pro-feminine principle, to avoid impunity for the aggressor and the re-victimization of women by the State. | en-US |
