| dc.description | Este artículo dice relación con el derecho humano al agua y al saneamiento en el derecho internacional, comparado y nacional. Sostiene que este derecho fundamental se encuentra implícito en la denominada Carta Internacional de Derechos Humanos, sin perjuicio de su recepción en tratados e instrumentos jurídicos diversos. Indica que varias constituciones lo han reconocido, expresa o tácitamente, y que existen fallos judiciales que lo han invocado para resguardar otros derechos en dichas jurisdicciones. Finalmente, sostiene que este derecho tiene un carácter iusfundamental en el ordenamiento jurídico nacional, existiendo algunas sentencias judiciales que lo han reconocido para fines diversos. | es-ES |
| dc.description | This article deals with the human right to water and sanitation in the international, comparative, and national law. It maintains that this fundamental right is implicit in the International Charter of Human Rights, besides being considered in international treaties and declarations. It points out that several constitutions recognized this right, either expressly or tacitly, apart from judicial decisions that invoked it to protect other human rights in those legal systems. Finally, it maintains that this is a fundamental right in the Chilean legal system and that there are some judicial decisions that recognized it for different objectives. | en-US |
