The purpose of this work is to analyze the constitutional recognition of the administrative sanctioning power. Although its exercise has operated under a tolerance regime backed by a profuse jurisprudential construction, it is worth analyzing, before a constituent process, the need to carry out an express regulation of said power in the Fundamental Charter. Along with this, the work proposes a series of rules that a possible general regulation of the sanctioning power should consider.Este trabajo tiene por objeto analizar el reconocimiento constitucional de la potestad administrativa sancionadora. Si bien su ejercicio ha operado bajo un régimen de tolerancia respaldado por una profusa construcción jurisprudencial, cabe analizar la necesidad de efectuar una regulación expresa de dicha potestad en la Carta fundamental. Junto con ello, el trabajo propone una serie de principios y reglas que una eventual regulación general de la potestad sancionadora debiera considerar.
