| dc.description | This article analyzes the states of exception from the review of their main elements from the perspective of democratic theory and its application in the constitutional and political history of Chile since the 19th century. He argues that the evolution of the states of exception in the Chilean constitutions of 1833, 1925 and 1980 evidences a pattern of institutional dependence, where the previous frameworks significantly determine the later design and that the institutional design has not been focused on the protection of the citizens. The state of siege has given power without due responsibility, and has been used frequently for political and social repression, and not for the preservation of the community. | en-US |
| dc.description | Este artículo analiza los estados de excepción a partir de la revisión de sus principales elementos desde la perspectiva de la teoría democrática y su aplicación en la historia constitucional y política de Chile desde el siglo XIX. Argumenta que la evolución de los estados de excepción en las constituciones chilenas de 1833, 1925 y 1980 evidencia un patrón de dependencia institucional, donde los marcos previos determinan de manera significativa el diseño posterior y que el diseño institucional no ha estado enfocado en la protección de los ciudadanos. El estado de sitio ha otorgado poder sin la debida responsabilidad, y se ha usado frecuentemente para la represión política y social, y no para la preservación de la comunidad. | es-ES |
