| dc.description | The Armed Forces and the Police in Chile are regulated in the Military Justice Code, which since its origins in 1925 has not undergone major modifications, being attached to norms and principles of the previous penal process. This regulation is reflected in the military jurisdiction victim, which differs from the civil victim case. It is important to ask whether such differentiated treatment is legally justified. Analyzing this through the constitutional equality principle, it is shown that an arbitrary discrimination exists between the victims, not respecting the due process of military justice. | en-US |
| dc.description | Las Fuerzas Armadas y Fuerzas de Orden y Seguridad Pública en Chile se encuentran reguladas en el Código de Justica Militar, el cual desde su origen en 1925 no ha sufrido grandes modificaciones, encontrándose aún ligado a los principios y normas del antiguo proceso penal. Lo anterior se refleja en la regulación de la víctima en sede militar que se diferencia de lo que ocurre en el caso de la víctima civil, por lo que es importante preguntarse si dicho trato diferenciado se encuentra justificado. Al analizar esto a través del principio de igualdad constitucional, queda de manifiesto que existe una discriminación arbitraria entre ambas víctimas, al no respetarse el debido proceso en la justicia militar. | es-ES |
